Welcome to The Luxara Homes, operated by Lynaro Group LLC (“The Luxara Homes,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your use of our website (theluxarahomes.com) and the preventive maintenance and related services we provide (“Services”).
By accessing our website or engaging our Services, you agree to these Terms. If you do not agree, please discontinue use of the website and Services.

1. Scope of Services

The Luxara Homes provides preventive home maintenance, inspections, and concierge-style property care for residential properties.
Our Services may include scheduled visits, inspections, light maintenance tasks, and documentation through the Luxara HomeCare Manual.
We do not provide emergency repair services, warranty coverage, or construction work unless expressly stated in writing.
All Services are subject to availability and limited to designated service areas within Texas.

2. Memberships and Payments

Our Services are offered through monthly membership tiers based on property size.
Membership begins when payment is received and your first visit is scheduled.
Your first month’s payment covers the creation of your personalized Luxara HomeCare Manual, including a full home walkthrough and documentation.
Within 15 days of your first visit, your manual is delivered, and monthly HomeCare service begins.

Payments are due according to your membership agreement. If payment fails or is not received, service may be paused or canceled.
All completed visits, manual creation, or current billing periods are non-refundable.

3. Scheduling and Access

Members agree to provide reasonable access to the property for scheduled visits.
If we cannot access your property as arranged, the visit may be rescheduled, and additional fees may apply.
Luxara Homes is not responsible for delays caused by weather, property conditions, or vendor availability.

4. Use of the Website

You agree to use theluxarahomes.com only for lawful purposes and in a way that does not infringe upon or restrict others’ use.
You may not attempt to access our systems without authorization, upload harmful materials, or use automated tools (robots, scrapers, etc.) to collect data.

5. Intellectual Property

All content, branding, text, and imagery on theluxarahomes.com are owned or licensed by Lynaro Group LLC and protected by U.S. copyright and trademark laws.
You may not reproduce, distribute, or use any content without written permission.

6. Marketing and Communications

By providing your contact information, you agree that The Luxara Homes may contact you regarding appointments, membership updates, or related offers.
You may opt out of promotional emails at any time by following the instructions in the message or contacting concierge@theluxarahomes.com.

7. Limitation of Liability

To the fullest extent permitted by law, Lynaro Group LLC and The Luxara Homes are not liable for any indirect, incidental, or consequential damages arising from your use of our Services or website.
Our total liability is limited to the amount paid for Services during the 3 months preceding any claim.
Preventive maintenance Services are designed to identify and reduce risks — they do not guarantee prevention of all property damage or system failure.

8. Warranties and Disclaimers

The website and Services are provided “as is” and “as available.”
We make no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
All recommendations are advisory; vendor work or repairs beyond our service scope are the responsibility of the homeowner and selected vendor.

9. Termination and Cancellation

You may cancel your membership at any time by written notice to concierge@theluxarahomes.com.
Cancellation is effective at the end of the current billing cycle.
We reserve the right to suspend or terminate Services for non-payment, repeated scheduling issues, or misuse of the Service.

10. Indemnification

You agree to indemnify and hold harmless Lynaro Group LLC, its officers, employees, and affiliates from any claims, losses, or damages arising out of your use of the website or Services, except in cases of gross negligence or willful misconduct by us.

11. Governing Law

These Terms are governed by and construed under the laws of the State of Texas, without regard to conflicts of law.
Any disputes shall be resolved exclusively in the courts of Dallas County, Texas.

12. Changes to These Terms

We may modify these Terms periodically. Updates will be posted on this page with the revised “Effective Date.”
Continued use of our website or Services after changes are posted constitutes acceptance of the new Terms.
